Even if your co. has 50 employee's or less as long as you have work and have earnings of $300 in the past 12mos. and paid into State Disability you are entitled to benefits from the state. You can look at your check stub under your deductions and see weather or not you have contributed to State Disab
  • something happend to the program. like i was saying, check your check stubs or check with H.R. you don't have to be employed at the time you file a claim. As long as you work in the past 12/mos and have earnings of $300 in the base period. Example. if you file a claim during Jan-March you need to have this earnings between Oct 2010-Sept 2011. April-June Jan 2011-Dec 2011 July-Sept April 2011-March 2012 Oct-Dec July 2011-June 2012. FMLA (Fam. Med Leave Act)protects your job while you are on leave, does not pay benefits. FMLA and CFRA (Ca Fam Rights Act)are federal and state leave laws, respectively, that allow an employee to take up to 12 workweeks of unpaid leave from his or her job in a 12-month period to care for themselves or family members who are ill, or children who are unable to take care of themselves. Paid Family Leave insurance does not change either law in any way and is completely separate from them. Paid Family Leave merely provides up to six (6) weeks of paid benefits to an employee who suffers a wage loss when taking time off work to care for others.
